These Terms of Service ("Terms") govern your access to and use of the POSje! platform — including the web backoffice, Flutter POS application, kitchen display system, QR ordering, and loyalty features — operated by Nextcode Sdn. Bhd. (Company No. [SSM]), a company registered in Malaysia ("we", "us", or "our").
By registering for an account or using any part of the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Eligibility & Account Registration
You must be at least 18 years old and have the legal authority to bind your business to these Terms. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
Notify us immediately at hello@nextcode.my if you suspect any unauthorised access to your account.
Free Trial
Good to know
New tenants receive a 14-day free trial with access to the highest-tier plan features. No credit card is required during the trial, and we do not auto-charge you at the end of a trial.
At the end of the trial period, your account will be paused until you select a paid subscription plan from your billing page. You retain full control and are never locked in.
Subscriptions & Payment
After your trial, continued use of the Service requires a paid subscription. Fees are billed monthly or annually in Malaysian Ringgit (MYR) as shown on our pricing page. All fees are exclusive of applicable taxes (including SST where required by Malaysian law), which will be added to your invoice. Payment is processed via Stripe.
We reserve the right to change pricing with 30 days' notice via email. If payment fails, we will notify you and provide a grace period of 7 days before access is suspended.
Refunds
We do not offer refunds for partial months. If you cancel mid-cycle, your access continues until the end of the billing period. Exceptional refund requests (e.g. duplicate charges) may be considered on a case-by-case basis — contact us within 14 days of the charge.
Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable Malaysian or international laws.
- Attempt to reverse-engineer, decompile, or extract source code from the Service.
- Use the Service to store or transmit malicious code, spam, or fraudulent data.
- Resell, sublicense, or provide the Service to third parties without our written consent.
- Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.
Your Data
You retain ownership of all data you upload to or generate within the Service ("Tenant Data"). You grant us a limited, non-exclusive licence to process Tenant Data solely to provide the Service. We do not sell your data.
You are responsible for ensuring that your collection and use of your customers' personal data through the Service complies with the Personal Data Protection Act 2010 (PDPA) and any other applicable laws. See our Privacy Policy for full details.
Intellectual Property
The Service — including all software, designs, trademarks, and content (excluding Tenant Data) — is owned by Nextcode Sdn. Bhd. and protected by Malaysian and international intellectual property laws. These Terms do not transfer any ownership rights to you.
Feedback or suggestions you provide may be used by us to improve the Service without obligation or compensation to you.
Uptime & Support
Our commitment
We target 99.5% monthly uptime for the core API and backoffice. Planned maintenance will be communicated in advance where possible.
Support is provided via email at hello@nextcode.my and WhatsApp during Malaysian business hours (Mon–Fri, 9am–6pm MYT). Enterprise plan customers have access to a dedicated account manager.
Limitation of Liability
To the maximum extent permitted by Malaysian law, Nextcode Sdn. Bhd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or business — arising from your use of or inability to use the Service.
Our total aggregate liability to you for any claim shall not exceed the total fees you paid in the 3 months preceding the claim.
Indemnification
You agree to indemnify and hold harmless Nextcode Sdn. Bhd., its directors, employees, and affiliates from any claims, losses, or damages (including legal fees) arising from your use of the Service, your Tenant Data, or your breach of these Terms.
Termination
You may cancel your subscription at any time from your billing page. We may suspend or terminate your account immediately if you breach these Terms, fail to pay, or if required by law.
Your data after termination
Upon termination, you may request an export of your Tenant Data within 30 days. After that window, data may be permanently deleted from our systems.
Modifications to Terms
We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
Governing Law & Dispute Resolution
These Terms are governed by the laws of Malaysia. Any disputes shall be referred first to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.
